Looks like there is a sanity clause

Abdul Rahman is going to be released under the rationale that since he converted from Islam, he must not be mentally fit to stand trial. As Steyn wrote, it's understandable that the U.S. wanted to get him released through back channels, but eventually this intolerance issue is going to have to be confronted.
